1.1 These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between PREMIUM ELITE LIMITED, 36 Grange View, Leeds, England, LS7 4ER (hereinafter "Provider") and the customer (hereinafter "Customer") via the Provider's website.

1.2 These GTC apply exclusively. Any differing, conflicting or supplementary GTC of the Customer shall only become part of the contract if and to the extent that the Provider has expressly agreed to their applicability.

3.2 The Customer may submit the offer via the integrated online ordering system. After entering their personal data, the Customer submits a legally binding contractual offer for the Products contained in the shopping cart by clicking the "Buy now" button.

3.3 The Provider may accept the Customer's offer within five days by sending the Customer an order confirmation by email or by delivering the ordered Products to the Customer.

5.2 Delivery generally takes place immediately after payment is received, but no later than within 24 hours.

5.3 The Customer is responsible for ensuring that their email inbox is functional and that emails from the Provider are not blocked by spam filters.

6.1 The Customer is generally entitled to a statutory right of cancellation.

6.2 In the case of digital content not supplied on a tangible medium, the statutory right of cancellation may expire pursuant to Section 356 (5) of the German Civil Code (BGB) once we have begun performing the contract, the Customer has expressly agreed that performance begins before the cancellation period expires, and the Customer has confirmed that they thereby lose their right of cancellation. 6.4 A payment reversal initiated without a valid legal basis may, in individual cases, be deemed unjustified or abusive and reviewed legally. The Customer's statutory rights, in particular in the event of a justified cancellation, justified termination of the contract, defect rights or other mandatory consumer protection rights, remain unaffected.

- You can inform us of your request for a return via the online cancellation form or live chat. - Refunds owed by law or contract are generally made within 7 working days using the original payment method.

7.1 Statutory liability for defects applies.

7.2 The Customer shall not receive any guarantees in the legal sense from the Provider unless these are expressly promised in the order confirmation.

7.3 In the event of access, activation or functionality issues, the Provider must first be given the opportunity, insofar as required by law, to examine and remedy the issue in accordance with Sections 327i, 327l BGB.

7.4 If the Provider incurs additional bank, payment or processing costs due to an unjustified payment reversal culpably caused by the Customer, the Provider may claim these as damages. The chargeback and processing fees regularly charged for this purpose by payment service providers or their banking and payment partners, in particular Klarna, PayPal, credit card companies or other acquirers, are regularly at least EUR 43.75. The Customer is expressly permitted to prove that no damage at all or substantially less damage has been incurred.

8.1 The Provider shall be liable without limitation for damages resulting from injury to life, body or health caused by a breach of duty by the Provider, its legal representatives or vicarious agents, as well as for other damages resulting from an intentional or grossly negligent breach of duty by the Provider, its legal representatives or vicarious agents.

8.2 For damages resulting from a slightly negligent breach of essential contractual obligations, the Provider shall only be liable up to the amount of damage typical for the contract and foreseeable, unless the Customer's claims for damages arise from injury to life, body or health.

The collection, processing and use of the Customer's personal data is carried out in accordance with the Provider's privacy policy.

## 10. Applicable law and place of jurisdiction

10.1 These GTC and all legal relationships between the Provider and the Customer shall be governed by the laws of the Federal Republic of Germany, excluding international uniform law, in particular the UN Convention on Contracts for the International Sale of Goods.

10.2 If the Customer is a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship shall be the Provider's registered office in Leeds, England.
